Terms of Service

These Terms of Service ("Terms") govern your use of PairNook — the mobile and web applications and related services (the "Service") operated from India ("PairNook", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What PairNook is

PairNook is a private companion app for couples. It provides end-to-end encrypted messaging and calling, shared life planning (to-dos, chores, groceries, reminders, dates, and expenses), games and daily questions for two, and a private memories timeline. Each account may be linked to exactly one partner at a time.

Both partners can report content and disconnect from or block the other at any time from within the app. We may suspend or terminate accounts that violate these Terms.

4. End-to-end encryption disclaimer

Your messages are end-to-end encrypted; in normal operation we cannot read them. In the current release an encrypted copy of your recovery key is escrowed on our servers so that your history restores automatically on a new device — the Security Whitepaper (section 4) explains exactly what that trade-off means. If you delete your account, the key backup and the escrowed key are deleted with it and your encrypted history becomes unrecoverable. See the whitepaper for details of what is and is not encrypted.

Because content is encrypted, we cannot proactively moderate messages. We act on user reports and on metadata where the law requires it.

5. Your content

You retain all rights to the content you create in PairNook. You grant us only the limited technical licence needed to store, transmit, and display it to you and your partner (for encrypted content, this means storing and relaying ciphertext). We claim no other rights in your content.

6. Account deletion

You may delete your account at any time from Settings inside the app. Doing so deactivates your account, severs your couple link, and deletes your server-side data as described in the Privacy Policy. Deletion is permanent and cannot be undone.

7. Service availability and changes

We aim for high availability but the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We may modify, suspend, or discontinue features with reasonable notice where practicable.

8. Limitation of liability

To the maximum extent permitted by applicable law, PairNook and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data (including encrypted data rendered unrecoverable by the loss of your devices and recovery key), loss of profits, or loss of goodwill arising out of or relating to your use of the Service. Our aggregate liability for any claim shall not exceed the amount you paid us for the Service in the twelve months preceding the claim (or INR 1,000 if you paid nothing). Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnity

You agree to indemnify us against claims arising from your violation of these Terms or of applicable law in your use of the Service.

10. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory consumer-protection rights in your place of residence, the courts of India shall have exclusive jurisdiction over disputes arising out of these Terms or the Service.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
